SCIFIPEDIA IS PROVIDED TO USERS UNDER THESE TERMS OF USE.
BY ACCESSING AND USING SCIFIPEDIA, YOU, THE USER, ACCEPT AND AGREE TO BE BOUND BY THESE TERMS OF USE. SCIFIPEDIA GRANTS YOU THE RIGHTS CONTAINED HERE IN CONSIDERATION OF YOUR ACCEPTANCE OF SUCH TERMS AND CONDITIONS.

OWNERSHIP
SCIFIPEDIA (INCLUDING ITS CONTENT AND LOOK AND FEEL) IS THE PROPERTY OF SCIFI.COM, A DIVISION OF NBC UNIVERSAL (“SCI FI”), ITS AFFILATED COMPANIES OR LICENSORS, AND IS PROTECTED BY COPYRIGHT, TRADEMARK AND OTHER APPLICABLE LAWS.
USE OF SCIFIPEDIA CONTENT
Except as described in this Terms of Use, you agree not to reproduce, duplicate, copy, create derivative works from, perform, sell, resell or exploit SCIFIPEDIA or any portion of SCIFIPEDIA (including any promotions and advertisements for SCIFIPEDIA) (collectively “SCIFIPEDIA”), without express written permission from SCIFIPEDIA.
Subject to the terms and conditions of these Terms of Use, SCI FI hereby grants you a royalty-free, non-exclusive, perpetual license in all media now known or hereafter devised for the following:
- reproduce one or more SCIFIPEDIA entries or articles on a website or other publication which may be made available to the public, so long as you link to the original entries and identify the source, and so long as you do not use this SCIFIPEDIA material in any manner that is primarily intended for or directed toward commercial advantage;
- display, print or download content on SCIFIPEDIA only for your personal, non-commercial, non-public use, provided you do not remove or alter any copyright, trademark, service mark or other proprietary notices or legends;
- reproduce or otherwise exploit without limitation any Submission you personally have contributed to SCIFIPEDIA.
You may not, without SCI FI's written permission, reproduce or copy (in whole or in part) SCIFIPEDIA, other than those parts you have contributed yourself, to create your own dictionary, encyclopedia or other research tool or for any other use without permission from SCI FI. You also may not engage in systematic retrieval of content either manually or otherwise from SCIFIPEDIA to create or compile, directly or indirectly, a collection, dictionary, encyclopedia, compilation, database, or directory, without written permission from SCI FI. You may not mirror on your own site the home page or results pages of SCIFIPEDIA, but you may link to SCIFIPEDIA.
If you want to post, publish, or use content from (or contained within) SCIFIPEDIA on your website or in any other Internet activity or make use of SCIFIPEDIA in a manner otherwise not covered under these Terms of Use, you will need permission from SCIFI.COM, even though your website or Internet activity may be free of charge. Requests should be directed to The Editor.
Licensor reserves the right to release SCIFIPEDIA under different terms or to cease distributing SCIFIPEDIA or any portion of SCIFIPEDIA at any time. Your right to use SCIFIPEDIA will terminate automatically upon any breach by you of these Terms of Use.
FAIR USE AND COMMENTARY
Nothing in this license is intended to restrict any rights you may have to comment or criticize content in SCIFIPEDIA or otherwise use portions of SCIFIPEDIA under the doctrine of “fair use.” For example, authors, reviewers, social scientists, jurists or students commenting on the content, operation, functionality or objectives of SCIFIPEDIA, for example, may refer to SCIFIPEDIA for commentary and criticism.

By contributing to SCIFIPEDIA, whether by submitting an entry, suggesting alterations to existing entries, or by sending photographs or any other materials to SCIFIPEDIA (“Submission”), you hereby grant to SCI FI the non-exclusive, royalty-free right to use, reproduce, derive, edit (in SCI FI’s sole discretion), transmit, display and perform the Submission in SCIFIPEDIA or for any other use by SCI FI in all media now known or hereafter devised in perpetuity. You acknowledge you will receive no payment for the exercise of these rights and that SCIFIPEDIA has the right, but not the obligation, to give you credit in a form to be determined in SCIFIPEDIA’s sole discretion.
Understanding and adhering to the Guidelines for Submissions is the responsibility of the user. SCIFIPEDIA is not responsible for monitoring or filtering submissions.
Should any Submission be found by SCI FI to violate the rights of any third party, to violate any law or regulation, to violate SCI FI’s Terms of Use or the Guidelines for Submissions or be otherwise offensive in SCI FI’s sole discretion, SCI FI may remove the Submission without notice. However, SCI FI is not obligated to restrict or monitor submissions to SCIFIPEDIA in any way, or to block users who submit inappropriate material.
You acknowledge that SCI FI may not and has no obligation to moderate the content of SCIFIPEDIA. You acknowledge and agree that the content and material in SCIFIPEDIA may not be accurate, that, in accordance with the disclaimers set forth below that you will appropriately evaluate and accept all risks associated with the use of any content, including critical analysis of the accuracy, completeness, or usefulness of such content.
SCIFIPEDIA VOLUNTEERS
Portions of SCIFIPEDIA are managed by volunteers who provide SCIFIPEDIA visitors with the ability to create and access Submissions. By acting as a volunteer, you agree that the content created as a result of your volunteer work for SCIFIPEDIA constitutes a "work for hire" and that all intellectual property rights in said content shall vest in SCIFIPEDIA at the time that it is created to the extent permitted by law. To the extent your work as a SCIFIPEDIA volunteer is not deemed a “work for hire” you assign all such rights in your work to SCI FI.

SCI FI MAKES NO EXPRESS OR IMPLIED WARRANTIES, REPRESENTATIONS OR ENDORSEMENTS WHATSOEVER WITH RESPECT TO SCIFIPEDIA. SCI FI EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NONINFRINGEMENT, WITH REGARD TO SCIFIPEDIA, ANY INFORMATION OR CONTENT CONTAINED THEREIN (INCLUDING THIRD PARTY INFORMATION). SCI FI AND NBC UNIVERSAL, INC. SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE ARISING EITHER DIRECTLY OR INDIRECTLY FROM ANY USE OF SCIFIPEDIA, THE SERVICE OR ANY INFORMATION OR CONTENT CONTAINED THEREIN (INCLUDING THIRD PARTY INFORMATION). V. ANY OTHER MATTER RELATING TO SCIFIPEDIA, EVEN IF SCI FI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH STATES, SCI FI AND NBC UNIVERSAL, INC.'S LIABILITY IS LIMITED AND WARRANTIES ARE EXCLUDED TO THE GREATEST EXTENT PERMITTED BY LAW.
INTERNATIONAL USE OF SCIFIPEDIA
SCIFIPEDIA is operated from and intended for use in the United States. SCIFIPEDIA makes no representation that content is appropriate or available for use outside the United States. Therefore, in recognition of the global nature of the Internet, Site users who are not residents of the United States agree to comply with local and regional laws regarding online conduct and use of the Site's content. Users who access SCIFIPEDIA from a location outside the United States are responsible for compliance with all applicable laws.
INDEMNIFICATION
You understand and agree that you are personally responsible for your behavior on SCIFIPEDIA and for your use of the content. You agree to indemnify, defend and hold harmless SCI-FI, NBC Universal, Inc., their subsidiaries, affiliated companies, joint venturers, business partners, licensors, employees, agents, and any third-party information providers to SCIFIPEDIA from and against all claims, losses, expenses, damages and costs (including, but not limited to, direct, incidental, consequential, exemplary and indirect damages), and reasonable attorneys' fees, resulting from or arising out of your use of SCIFIPEDIA, including use or unauthorized copying of SCIFIPEDIA, the violation of these Terms of Use or any applicable laws or regulations.
APPLICABLE LAW
The construction, validity, interpretation and enforceability of the Terms of Use will be governed by and construed in accordance with the internal laws of the State of New York without giving effect to any choice of law or conflict of law rules.

MISCELLANEOUS
These Terms of Use constitute the entire agreement between the parties with respect to your use of SCIFIPEDIA content. The SCIFI.COM Terms of Service and Submission Guidelines govern your use of the SCIFI.COM site, including that portion of the site dedicated to SCIFIPEDIA. SCIFI.COM shall not be bound by any additional provisions that may appear in any communication from you unless signed by SCIFI.COM. These Terms of Use and their performance will be binding on you and your heirs, administrators, executors, successors and assigns. The invalidity of any provision will not affect the remaining provisions. If any portion of these Terms of Use is found to be invalid, illegal or unenforceable, for any reason, that portion shall be severed from the rest and shall in no event affect any other portion of the agreement, including without limitation, the ability to resolve all controversies and claims through arbitration. No term or provision of these Terms of Use shall be deemed waived and no breach consented to unless such waiver or consent shall be in writing and signed by the party to be charged with such waiver or consent.
You may not assign your rights under this Agreement except as approved by SCIFI.COM, and any unauthorized, purported assignment will be null and void. SCIFI.COM, NBCU and their successors and assigns, will have the unlimited right to assign these Terms of Use and the rights granted at any time, in whole or in part, to any party.
These Terms of Use may be changed or updated from time to time and any changes will become binding upon users once they are posted.
